1. Introduction

These Terms of Service ("Terms") govern your access to and use of EthnioQuiz ("the Service"), a web-based game operated by Simbiotic Digital ("we", "us", or "our"). These Terms are effective as of April 2026.

By accessing or using EthnioQuiz, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must discontinue use of the Service immediately.

2. Description of Service

EthnioQuiz is a free-to-play, web-based nationality guessing game. Users are presented with photographs of real people and must guess the country of origin from the options provided. The game is accessible at ethnioquiz.com through any modern web browser on desktop or mobile devices.

The Service includes multiple game categories, leaderboards, virtual currency, and optional in-app purchases. Certain features may be added, modified, or removed at our discretion.

3. Eligibility

EthnioQuiz is open to users of all ages. No account creation is required to play the game. Minors (under the age of 16, or the age of digital consent in your jurisdiction) should obtain parental or guardian consent before using the Service or making any purchases.

Parents and guardians are responsible for monitoring their children's use of the Service, including any in-app purchases made through the platform.

4. User Conduct

When using EthnioQuiz, you agree to the following rules of conduct:

• Choose appropriate nicknames for leaderboards. Nicknames that are offensive, hateful, discriminatory, sexually explicit, or misleading (such as impersonating others) are strictly prohibited.
• Do not attempt to manipulate scores, rankings, or leaderboard positions through any dishonest means, including exploiting bugs or vulnerabilities.
• Do not interfere with, disrupt, or attempt to gain unauthorized access to the Service, its servers, or any connected networks.
• Do not use automated tools, bots, scripts, or any form of software to interact with the Service or gain an unfair advantage.

We reserve the right to remove content, reset scores, or restrict access for users who violate these rules, at our sole discretion and without prior notice.

5. Virtual Currency (Coins)

EthnioQuiz features a virtual currency system ("Coins") that allows users to unlock additional game categories and content.

• Coins can be earned through gameplay. Achieving 10 or more correct answers in a single game session awards Coins.
• Coins can also be purchased with real money at the following rates:

• Coins are used exclusively to unlock additional game categories within EthnioQuiz.
• Coins have no real-world monetary value and cannot be exchanged, transferred, or redeemed for cash or any other form of compensation.
• Coins are stored locally in your browser's storage. We are not responsible for loss of Coins resulting from clearing browser data, switching devices, or any other action that removes local storage data.

6. In-App Purchases

EthnioQuiz offers the following optional purchases:

• All purchases are final. Refund requests are handled in accordance with the policies of the applicable app store or payment provider.
• Purchases are tied to the specific device and browser used at the time of purchase and are non-transferable. If you clear your browser data or switch devices, purchased features may no longer be available.
• We reserve the right to modify pricing, offers, and available products at any time. Any changes will not affect purchases already completed.

7. Leaderboards

EthnioQuiz features public leaderboards that display user scores and nicknames. By submitting a score to the leaderboard, you acknowledge and agree to the following:

• Your chosen nickname and score will be publicly visible to all users of the Service.
• We reserve the right to remove, modify, or reset any leaderboard entries that we reasonably believe to be fraudulent, manipulated, or in violation of these Terms.
• Leaderboard rankings may be reset periodically, whether for seasonal events, maintenance, or at our discretion. We will endeavor to provide advance notice when possible.

8. Intellectual Property

All intellectual property rights in and to EthnioQuiz, including but not limited to its name, logo, visual design, user interface, source code, game mechanics, and all associated content, are owned by or licensed to Simbiotic Digital.

• Photographs used within the game are sourced and used under appropriate licenses. These images remain the property of their respective rights holders.
• You may not copy, reproduce, modify, distribute, transmit, display, perform, publish, license, create derivative works from, or sell any part of the Service or its content without prior written permission from Simbiotic Digital.
• The EthnioQuiz name and branding may not be used in connection with any product or service that is not ours, or in any manner that is likely to cause confusion or that disparages the Service.

9. Advertising

The free version of EthnioQuiz includes third-party advertising served through Google AdSense and other advertising networks. By using the free version of the Service, you acknowledge and agree to the following:

• Advertisements may appear during gameplay, between game sessions, or in other areas of the interface.
• Users may remove all advertising by purchasing the "Remove Ads" option (2.99 €) or the "VIP Pack" (9.99 €).
• Advertising content is provided by third-party networks. We do not control, endorse, or assume responsibility for the content, accuracy, or availability of any third-party advertisements.
• Your interaction with any advertisement is solely between you and the advertiser. We are not liable for any loss or damage arising from such interactions.

10. Disclaimers

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Any warranty that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
• Any warranty regarding the accuracy, reliability, or completeness of any content provided through the Service.

All game data, including scores, Coins, unlocked categories, and preferences, is stored locally in your browser. We are not responsible for any data loss resulting from clearing browser data, device changes, browser updates, or any other circumstances beyond our control.

We do not guarantee continuous, uninterrupted access to the Service. The Service may be temporarily unavailable due to maintenance, updates, server issues, or other factors.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Simbiotic Digital, its directors, employees, partners, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with:

• Your use of or inability to use the Service.
• Any unauthorized access to or alteration of your data.
• Any third-party content, including advertisements, accessed through the Service.
• Any other matter relating to the Service.

In no event shall our total aggregate liability to you for all claims arising from or related to the Service exceed the total amount you have paid to us in the twelve (12) months immediately preceding the event giving rise to the claim. If you have not made any payments, our liability shall not exceed ten euros (10 €).

12. Modifications to These Terms

We reserve the right to update, modify, or replace these Terms at any time at our sole discretion. When we make material changes, we will update the "Effective date" at the top of this page.

Your continued use of the Service after any modifications to these Terms constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you should discontinue use of the Service.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Spain and applicable European Union regulations, without regard to conflict of law principles.

Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Spain. If you are a consumer residing in the European Union, you may also be entitled to invoke the mandatory consumer protection laws of your country of residence.

Nothing in these Terms shall affect your statutory rights as a consumer under applicable EU law, including the right to bring proceedings in the courts of your country of residence.
